We’ve been busy with real estate and anticipate even more activity this fall when everyone returns from vacation and thinks, “I meant to buy/sell a house.” While interest rates are still a bit of a drag, there’s a glimmer of hope for a potential adjustment by late September. Time will tell!

By now, you’ve likely heard about the upcoming changes from the National Association of Realtors’ class action suit. The settlement will remove all references to compensation in MLS listings and feeds, and historical compensation data will no longer be searchable. Although this transition might involve some extra work, the aim is to enhance transparency and empower consumer choice in the home buying and selling process.
- On the listing side, sellers may offer concessions to buyers, which can be used to cover the compensation due to the buyer’s agent. However, these concessions will not be listed in the MLS. Buyer’s agents will have separate agreements with their clients, yet may negotiate compensation directly when writing a contract. This change is designed to promote transparency and stimulate more meaningful conversations about consumer choice. I am closely studying the new requirements and am committed to representing you with the highest level of expertise and ensuring your needs are prioritized.
- On the buyer’s side, all agents must have a buyer’s agreement in place before showing homes. This agreement must outline the agent’s compensation to be paid by the buyer. As always, I am here to provide the necessary data to help you make informed decisions and to represent you with the utmost professionalism.
With any rule or law change, there will be questions. For example, will entry-level buyers only look at homes offering concessions? Will sellers reduce their prices if no offers of concessions are made? Will appraisals adjust for historical compensation data? These questions and more will be addressed as we navigate these changes together.
We can still advertise seller-paid concessions on our listings through MLS alternatives such as social media, flyers, and personal websites.
